Step 2 : Statement of Claim

With your instructions, we will then draft the Statement of Claim and email the document to you. You will then have to print it and swear the affidavit where indicated, before a Justice of Peace. You will then have to send it back to us, by post, for filing. If the debtor is an individual, the Court would serve the document directly to the debtor (to the address you have provided in the Debtor Information form). If the debtor is a company, the Court would send the document back to us, and we will serve it through post to the registered address of the company (If you do not know the registered address of the company, our agent will do a company search for you for a fee.)

After 30 days upon service of the Statement of Claim, you are to advise whether:

  • you have been paid;
  • arrangements has been made for the payment of the debt;

AND

  • whether you want to continue to the next step.
